Sylvanus Eruaga, a lawmaker representing Etsako West Constituency ll in the Edo State House of Assembly has asked the court to order the withdrawal of the Certificate of Return given to Seid Oshiohmole, who was declared winner of the State House of Assembly poll in the constituency.
Seid Oshiomhole is the younger brother of Adams Oshiomhole, National Chairman of the All Progressives Congress (APC).
Defendants in the suit with number FHC/B/CS/36/2019, are the Independent National Electoral Commission (INEC), the APC Seid Oshiomhole, Edo State House of Assembly, Edo State government and the Clerk, Edo State House of Assembly.
Eruaga, a PDP lawmaker, through his Counsel, Barr. Dele Igbinedion, told the court the seat which INEC conducted the March 9th 2019 election was not vacant.
Eruaga said that his constitutionally prescribed four-year tenure would expire on the 5th April 2020.
Eruaga asked the court to withdraw the certificate of return, relying on subsisting Court of Appeal judgment delivered on December 19th 2015 (Appeal No CA/EPT/ 343/3015) in his favour.
