Busola Dakolo Case Thrown Out For Lack Of Evidence –Ubani

The former Second Vice- President of the Nigerian Bar Association, Onyekachi Ubani says the rape case filed against Founder of the Commonwealth of Zion Assembly ( COZA), Biodun Fatoyinbo by Busola Dakolo, was thrown out over lack of evidence.

In a chat with AN24, Ubani a one-time Chairman of the Ikeja branch of the NBA said that the matter was a civil case, and before faulting the judge, people should have a better understanding of what the law says.

“There was a lack of evidence. When the alleged rape happened, she didn’t file a police report. If she had, that would have been easy to reference. So, the court felt it was a waste of their time because there was no substantial evidence to show. And that was why damages were awarded against her.”

Busola, a celebrity photographer had filed a lawsuit in September where she had accused Fatoyinbo of raping her when she was younger and had demanded “a personal letter of apology” from the cleric to show honest remorse for his alleged misdeeds.

The case was however thrown out on Thursday by Justice Oathman Musa who held that the matter amounted to injustice, an abuse of judicial and that the it was aimed more at cruelty than obtaining justice.

The ruling of the court had however been greeted with varied reactions from supporters of both Fatoyinbo and Dakolo.

While some were in support of the verdict of the court, others saw it as a travesty while alleging that that the justice system had been compromised.
