General Overseer of Sotitobire Praising Chapel, Akure, Bishop Alfa Babatunde has filed a lawsuit against the Department of State Services claiming unlawful arrest and detention.
The pastor has been in the custody of the DSS after a one-year-old boy, Kolawole Gold went missing during a Sunday service at the church back in November.
His church was set ablaze on Wednesday when rumours made the rounds about how the missing boy had been exhumed from the alter.
His counsel, Mr. Yemi Omoware in the suit, prayed the court to grant an order compelling the DSS to release the pastor from their custody, citing abuse of legal process and violation of his fundamental rights.
The pastor sought an order “restraining the respondents, their agents, servants, subordinates and or any person(s) taking instructions from them whatsoever/ whosoever from engaging in any further acts of arrest, detention and violation of his right to liberty and or dignity of human person”.
He demanded N100m damages against the respondents who are Department of State Services, Director-General of the DSS, and Messrs Emmanuel Anaobi, Isaac Babalola and Remi Oluwalogbon.
