Court Strikes Out Suit Against Ike Ekweremadu
A Federal High Court in Abuja, has struck out charges of non-declaration of assets instituted against a former Deputy Senate President, Ike Ekweremadu for lack of diligent prosecution.
The case was instituted by the defunct Special Presidential Investigation Panel for the Recovery of Public Property led by Mr. Okoi Obono-Obla. The panel had alleged Ekweremadu neglected to declare his assets after being served the panel’s notice to do so.
The office of the Attorney-General of the Federation took over the case after the dissolution of the SPIP.
But on Monday, presiding judge, Justice Binta Nyako would not accede to the request of a counsel from the AGF’s office, Pius Akutah who wanted her to make an order for the former counsel handling the matter to release the case file. He had claimed that the said counsel disappeared with the case file.
“You are attorney general (referring to the lawyer as representing the AGF), you should know what to do. You should not be waiting for me to make an order against an individual.
“So, as it is today, you don’t know the case against the defendant since you don’t have the file. I am going to strike out the case, when you are ready you can come back.
“The case is hereby struck out for want of diligent prosecution. The prosecution is allowed to come back whenever they are ready to proceed with the case, ” she said.
